NASA provides a super-speed look at Webb Telescope progress

Mar. 27, 2013 ? NASA released a new sped-up, 32-second video that shows engineers working on some of the James Webb Space Telescope's flight components to integrate them together to ensure they will work perfectly together in space.

The "NASA Webb Clean Room at Super-speed" video was filmed in the giant clean room at NASA's Goddard Space Flight Center in Greenbelt, Md., and produced at Goddard. The video is available on a NASA website in HD at: http://svs.gsfc.nasa.gov/goto?11220 . Testing of the two flight instruments that have been delivered to Goddard has been ongoing in the past several months.

? Larger image Engineers and scientists at Goddard have begun assembling the four science instruments together. In a recently released video from NASA clean room personnel are shown installing the Fine Guidance Sensor (FGS) instrument into a larger structure called the Integrated Science Instrument Module (ISIM) structure. The ISIM structure is the larger skeletal structure in the video, and the FGS is the object on the end of a balance beam being moved by a crane.

"This is the integration of the FGS/NIRISS instrument onto the ISIM structure," said Scott Lambros, Webb Instrument systems manager at Goddard. "This is the first of the four instruments to be integrated on the structure and is a very exciting time. It clearly shows we are moving into a new phase, from development, into the integration and then testing phase."

The FGS is actually one half of a combination instrument with the Near-Infrared Imager and Slitless Spectrograph (NIRISS) science instrument. The FGS will enable the telescope to accurately and precisely point at the correct, intended objects for it to observe.

"The Webb telescope fine guidance sensor which provides pointing stability, or image stabilizer control, has been installed and being readied for testing together with other instruments in the ISIM," said Ray Lundquist, ISIM systems engineer at Goddard.

The FGS is packaged together as a single unit with the NIRISS science instrument and is developed and provided by the Canadian Space Agency and its prime contractor, COM DEV.

The ISIM is the whole integrated system of instruments on the Webb. It's one of four major elements that comprise the Webb Observatory flight system. It contains the four science instruments that will detect light from distant stars and galaxies, and planets orbiting other stars. The ISIM itself provides electrical, computational and heat management services for the science instruments.

"The MIRI instrument will be the next to be integrated onto the structure within the next month, with the NIRCam and NIRSpec instruments to follow later this year," Lambros said.

Another video was released last year produced by the Space Science Telescope Institute of Baltimore, Md., in the "Behind the Webb" series. That video, called "Canada's Dynamic Duo," took viewers behind the scenes where the instruments were created, and is on-line.

The most powerful space telescope ever built, Webb is the successor to NASA's Hubble Space Telescope. Webb's four instruments will reveal how the universe evolved from the big bang to the formation of our solar system. Webb is a joint project of NASA, the European Space Agency and the Canadian Space Agency.

Owen Wilson-led animated film gets new title

NEW YORK (TheWrap.com) - Relativity and Reel FX have renamed their upcoming animated film "Free Birds," replacing the previous title of "Turkeys."

"Turkeys" was a working title, and the parties felt that this new name aptly fit a raucous buddy comedy. It has not yet been decided if the Lynyrd Skynyrd song will be used (but we asked).

The film features the voices of Owen Wilson and Woody Harrelson as two spunky turkeys that take a time machine back to the first Thanksgiving. They want to expunge turkeys from Thanksgiving's culinary tradition.

Amy Poehler will voice the female lead while Dan Fogler, Lesley Nicol of "Downton Abbey," George Takei of "Star Trek" fame, Keith David and Colm Meaney all lend their voices as well.

Relativity decided in February to move the release of the film up a year from November 14, 2014 to November 1 of this year because of an opening in the calendar and its confidence in its early sneaks of the film.

From Tap To Zap: Tapulous Co-Founder Shoots For The Moon With ...

Tapulous, one of the earliest, big mobile games makers for the iPhone, made its splash with Tap Tap Revenge, the first in a series of apps where users tapped on dropping balls in time with music ? a formula that proved wildly successful and eventually resulted in the company getting bought by Disney in 2010 for reportedly $50 million. Now, one of the co-founders of Tapulous, the Australian Andrew Lacy, has hotfooted it to Paris to tackle something new: the online travel market, with the launch of ZapTravel, a semantic travel search engine.

The idea of ZapTravel is to do away with the need for all the extra ?data entry? required by many travel sites today, from selecting calendar dates to entering destinations from pop-up menus and more. ZapTravel searches are based on what you type into a single window, with details ?human? as what you?d type to a friend. For example, ?I?d like to go to Stockholm.?

When you register, ZapTravel makes note of your location, so all searches are by default from there. You can also set other defaults around, say, how fancy/budget you?d like your accomodation to be. ZapTravel then creates discounted trips based on the information you have provided, offering flights and hotel options. It?s working with some 3,000 partners now to create those deals. With the longer-term emphasis on experiences as much as getting you from point A to B, it looks like the plan is to present more packages in the longer run (not just directing you to a cool city for food, but suggesting and booking a table at a top restaurant).

In that sense, ZapTravel is also trying to cater to users who are undecided about where they would like to go. Lacy says that since ZapTravel?s soft launch last week, one of the most popular search terms (go Internet go!) has been ?sex,? to which ZapTravel?s engine ?diligently returns dynamically constructed deals for nightlife destinations and places with lively atmosphere.? It also includes city guides, created by aggregating content from other sites like Frommers and locals enlisted by ZapTravel.

Lacy ? who is a lawyer and MBA by training but coded half the site ? describes ZapTravel as ?a learning system.? He says that there is an ongoing mix of algorithmic processing, along with some human shaping. The platform?s ?vocabulary? already has ?3,000?destinations, 10,000 different reasons to go, and 15,000 events? to trigger search results, says Lacy.

?The more people use it and the more content we feed it, the better it is able to put together packages to match specific interests,? he says. Others on ZapTravel?s team include engineer?Nicolas Martignole, who organizes the French Java conference?Devoxx France,?and used to build?complex financial systems for Reuters; user experience specialist?Olivier Desmoulins; and?Mathieu Seguin. There is also a separate office for development in Eastern Europe, says Lacy.

Where games end and travel begins

ZapTravel and Tapulous couldn?t be more different ? one mobile-first and created for pure entertainment, and the other launching first on desktop and focused on e-commerce and using new technology around semantic search to help complete travel transactions; one based in Palo Alto and the other anchored in Paris ?because Europe is a much bigger market for travel in general.? But there are some threads between the two. In addition to the entrepreneur himself, there is the fact that both are trying to create markets for products that have yet to be established.

In the case of Tapulous, it was making iPhone apps before Apple had even officially moved into the space itself. ZapTravel, meanwhile, is hoping to establish itself as a semantic travel platform at a time when the playing field is still wide open.

But that is changing.

For one, services like Siri on the iPhone and Google Now on Android offer users quicker, less labor intensive ways of discovering new information; and that is whetting people?s appetite to have easier user experience everywhere. In addition, the ever-growing number of online travel options ? why book an expensive, touristy hotel on Travelocity if you can stay in a cute loft with Airbnb? ? will mean that those sites that make it easier to give you the right information stand to win your business.

On top of that, there has been some significant M&A in the space as the bigger players in online travel look to expand their features more to compete against others, with huge deals like Priceline?s acquisition of Kayak?for $1.8 billion, Expedia?s majority stake in Trivago?for $632 million, and also smaller startup plays like Tripadvisor buying Tiny Post last week.

Would-be competitors include Expedia, which is beta-testing a semantic search called YourVisit; and?CheapAir, which is beta-testing ?Easy Search? for semantic searches of flights. Among startups, there is Desti, the ?personal travel assistant? spun out from Siri-creators Sri International. And?Hopper, staffed up by a team that left Expedia that has raised $22 million?for what also appears to be a semantic search app, but it is still in stealth mode.

ZapTravel will be trying to meet the market and exceed what others are already doing.

?The travel industry has a lot of poor quality experiences,? says Lacy. ?I learned how to make beautiful products at Tapulous and that?s what i?m trying to do here.?

He says that plans for the mobile app will include the ability to enter search requests by voice as well as text. One area I?ve seen that will need room for improvement is its ability to deal with people who make typos (like me). This too is being worked on, says Lacy.

ZapTravel is currently bootstrapped but is in the process of raising an Angel round that it expects to close in the next few months.

You can now pay $50 to have Rogers unlock a device bought on contract if it's either fully paid off or has been on the network for 90 days, making it easier to take your phone on a vacation -- or to a rival carrier, if you also pony up any relevant cancellation fees. Another big danger, especially for cats is the Easter lily, which is extremely toxic if ingested by your cat. So be sure to keep any plants in the lily family out of reach from your pet. The last thing you want to do is spend your holiday in a veterinary emergency room!

I speak from experience when I say that you need to keep all alcohol out of your pets reach too. My oldest Yorkie Elvis nearly died when he was a little puppy, after taking a swig out of my girlfriends cocktail with Scotch in it at Christmas, and we spent Christmas eve in the vets ER room, while they gave him charcoal to soak up the liquor and sober him up!

The next book by primatologist Jane Goodall has been postponed because some passages were lifted from online sources and not properly credited.

Hachette Book Group announced Friday that no new release date has been set for Goodall's "Seeds of Hope," originally scheduled for April 2. Goodall said in a statement that she agreed to delay the book and "correct any unintentional errors."

Goodall also apologized.

"During extensive research I spoke to as many experts as possible," Goodall said in a statement released by the Jane Goodall Institute. "I also visited numerous websites dedicated to celebrating, protecting and preserving the plants of the world. This was a long and well researched book, and I am distressed to discover that some of the excellent and valuable sources were not properly cited, and I want to express my sincere apologies."

"It is important to me that the proper sources are credited, and I will be working diligently with my team to address all areas of concern," said Goodall, who has written or co-written more than 20 books.

Hachette said excerpts that appeared this month in Smithsonian magazine did not contain questionable material.

Goodall, 78, co-authored "Seeds of Hope" with Gail Hudson, who has written for Nature, Good Housekeeping and other publications. The book is being billed as a study of "the critical role that trees and plants play in our world."

Earlier this month, a Washington Post freelance reviewer alerted the paper to numerous similarities between material in "Seeds of Hope" and passages on Wikipedia and on websites for organic tea and the history of tobacco.

"My goal is to ensure that when this book is released it is not only up to the highest of standards, but also that the focus be on the crucial messages it conveys," Goodall said. "It is my hope that then the meaningful conversation can resume about the harm we are inflicting on our natural environment and how we can all act together to ensure our children and grandchildren inherit a healthy planet."

Other authors in recent years have used Internet material without attribution, including Chris Anderson, whose 2009 book "Free: The Future of a Radical Price" contained passages taken verbatim from Wikipedia.

Forbes values Yankees at $2.3 billion

NEW YORK (AP) ? Forbes estimated the New York Yankees have the highest value in Major League Baseball for the 16th straight year at $2.3 billion, and the average for an MLB team increased by 23 percent in the last year to $744 million.

The magazine said Wednesday the Yankees' value increased from $1.85 billion last year.

The Los Angeles Dodgers are second in MLB at $1.62 billion ? nearly $400 million below the price paid for the team last May when a group headed by Mark Walter, Stan Kasten and Magic Johnson bought the franchise from Frank McCourt.

Forbes valued Boston third at $1.3 billion, followed by the Chicago Cubs ($1 billion), Philadelphia ($893 million), the New York Mets ($811 million), San Francisco ($786 million), Texas ($764 million), the Los Angeles Angels ($718 million) and St. Louis ($716 million).

Being exposed to arguments between parents is associated with the way babies' brains process emotional tone of voice, according to a new study to be published in Psychological Science, a journal of the Association for Psychological Science.

The study, conducted by graduate student Alice Graham with her advisors Phil Fisher and Jennifer Pfeifer of the University of Oregon, found that infants respond to angry tone of voice, even when they're asleep.

Babies' brains are highly plastic, allowing them to develop in response to the environments and encounters they experience. But this plasticity comes with a certain degree of vulnerability research has shown that severe stress, such as maltreatment or institutionalization, can have a significant, negative impact on child development.

Graham and colleagues wondered what the impact of more moderate stressors might be.

"We were interested in whether a common source of early stress in children's lives conflict between parents is associated with how infants' brains function," says Graham.

Graham and colleagues decided to take advantage of recent developments in fMRI scanning with infants to answer this question.

Twenty infants, ranging in age from 6 to 12 months, came into the lab at their regular bedtime. While they were asleep in the scanner, the infants were presented with nonsense sentences spoken in very angry, mildly angry, happy, and neutral tones of voice by a male adult.

"Even during sleep, infants showed distinct patterns of brain activity depending on the emotional tone of voice we presented," says Graham.

The researchers found that infants from high conflict homes showed greater reactivity to very angry tone of voice in brain areas linked to stress and emotion regulation, such as the anterior cingulate cortex, caudate, thalamus, and hypothalamus.

Previous research with animals has shown that these brain areas play an important role in the impact of early life stress on development the results of this new study suggest that the same might be true for human infants.

According to Graham and colleagues, these findings show that babies are not oblivious to their parents' conflicts, and exposure to these conflicts may influence the way babies' brains process emotion and stress.

Being exposed to arguments between parents is associated with the way babies' brains process emotional tone of voice, according to a new study to be published in Psychological Science, a journal of the Association for Psychological Science.

The study, conducted by graduate student Alice Graham with her advisors Phil Fisher and Jennifer Pfeifer of the University of Oregon, found that infants respond to angry tone of voice, even when they're asleep.

Babies' brains are highly plastic, allowing them to develop in response to the environments and encounters they experience. But this plasticity comes with a certain degree of vulnerability research has shown that severe stress, such as maltreatment or institutionalization, can have a significant, negative impact on child development.

Graham and colleagues wondered what the impact of more moderate stressors might be.

"We were interested in whether a common source of early stress in children's lives conflict between parents is associated with how infants' brains function," says Graham.

Graham and colleagues decided to take advantage of recent developments in fMRI scanning with infants to answer this question.

Twenty infants, ranging in age from 6 to 12 months, came into the lab at their regular bedtime. While they were asleep in the scanner, the infants were presented with nonsense sentences spoken in very angry, mildly angry, happy, and neutral tones of voice by a male adult.

"Even during sleep, infants showed distinct patterns of brain activity depending on the emotional tone of voice we presented," says Graham.

The researchers found that infants from high conflict homes showed greater reactivity to very angry tone of voice in brain areas linked to stress and emotion regulation, such as the anterior cingulate cortex, caudate, thalamus, and hypothalamus.

Previous research with animals has shown that these brain areas play an important role in the impact of early life stress on development the results of this new study suggest that the same might be true for human infants.

According to Graham and colleagues, these findings show that babies are not oblivious to their parents' conflicts, and exposure to these conflicts may influence the way babies' brains process emotion and stress.

Cyprus turns to Brussels for help on bailouot

BRUSSELS (AP) ? After failing for a week to find a solution at home to a crisis that could force it into bankruptcy, Cypriot politicians were turning to the European Union on Sunday in a last-ditch effort to help the island nation forge a viable plan to secure an international bailout.

Politicians are under pressure to come up with a solution quickly, with the European Central Bank threatening to stop providing emergency funding to Cyprus' banks after Monday if there is no agreement on a way to raise 5.8 billion euros ($7.5 billion) needed to get a 10 billion euro rescue loan package from the other European countries that use the single currency and the International Monetary Fund.

If Cyprus fails to secure a bailout, some of its ailing banks could collapse within days and rapidly drag down the government and possibly force it out of the euro, a huge threat to the stability of the currency used by more than 300 million people in 17 EU nations.

Despite the danger, Europe's biggest economy maintained a hard line. German Finance Minister Wolfgang Schaeuble said that "if possible we want to avoid seeing Cyprus sliding into insolvency."

But, he added in an interview with the German newspaper Welt am Sonntag published Sunday that Cyprus cannot expect compromise over the threat of bankruptcy and possibility it could leave the eurozone.

"I'm also known for not giving in to blackmail, by nobody and nothing," he said.

The original plan, agreed to in marathon negotiations earlier last week, called for a one-time levy on all bank depositors in Cypriot banks. But the proposal ignited fierce anger among Cypriots and failed to garner a single vote in the Cypriot Parliament.

The idea of some sort of deposit grab has returned to the fore after Cyprus' attempt to gain Russian financial aid failed this week, with deposits above 100,000 euros at the country's troubled largest lender, Bank of Cyprus, possibly facing a levy of up to 25 percent.

Cypriot President Nicos Anastasiades and his finance minister traveled to Brussels for meetings with European Union leaders.

European Council President Herman Van Rompuy was chairing a meeting, but a spokesman insisted his role was not to force a deal but to encourage discussion.

To avoid bankruptcy or the collapse of its banking system, Cyprus needs significantly more than the 10 billion euros the international creditors are willing to lend it. They fear that more loans would balloon the country's debt level to an unsustainable level. For that reason, the country must somehow raise the additional money.

Cyprus has "to fulfill a difficult mission to save the Cypriot economy and avert a disorderly default threatening the economy if there is no final deal for the loan agreement," government spokesman Christos Sylianides said in a written statement Sunday.

Officials fear that a Cypriot bankruptcy, which would likely force the country to become the first eurozone member to leave the currency bloc, would roil markets and result in uncertainty that could engulf other weaker eurozone nations, leader to capital flight and higher government borrowing costs.

Anastasiades was also set to meet IMF Chief Christine Lagarde and ECB President Mario Draghi.

If the Cypriots agree to a plan on Sunday, the IMF, European Central Bank and European Commission will then determine whether it meets the requirement that Cyprus' debt, including any new bailout loan, be sustainable over the long run.

Any new proposal would then have to be approved Sunday evening by the Eurogroup, the gathering of finance ministers from the 17 EU countries that use the euro currency.

Their decision might come only as a broad political agreement, with technical details to be hammered out in the coming days. But without an agreement in principle, the ECB is likely to pull the plug on the country's banking system.

Cyprus already took significant steps toward cementing a new plan Friday night, when lawmakers voted to restructure ailing banks, restrict financial transactions in emergencies and set up a "solidarity fund" that should act as the vehicle for raising funds from investments and contributions.

The bank restructuring will include the country's second largest lender, Laiki, which suffered heavy losses after being exposed to toxic Greek debt. The restructuring and the sale of Greek branches of Cypriot banks are expected to significantly lower the 5.8 billion euros that the country needs to raise on its own to secure the rescue loan package.

Cypriot banks have been shut this past week while the plan was being worked out, and are not due to reopen until Tuesday. Cash has been available through ATMs, but many run out quickly.

Chamber President: State needs Panthers to stay in Charlotte

CHARLOTTE, NC (WBTV)- The Charlotte Chamber announced Friday that they are launching a public campaign to help keep the Carolina Panthers in Charlotte.

Chamber President Bob Morgan responded to questions from members of the NC General Assembly this week.

"How many times does a public official have the chance to secure a payroll of $2.8 billion for their state's economy? That's the question now facing members of North Carolina's General Assembly as they consider whether or not and how to participate in the effort to renovate Bank of America Stadium," Morgan said in his remarks.

The Panthers have asked the city and state for about $200 million in public funds to renovate and add upgrades to Bank of America Stadium.

The city of Charlotte has requested that the state legislature approve a one percent increase to the city's prepared food and beverage tax to help pay for the upgrades. That legislation has hardly advanced through one of the two chambers.

"If the State of North Carolina stands to receive nearly $300 million in tax revenues from the Panthers over the next 15 years, that's a solid business decision. Even if it means giving us the right to tax ourselves to keep the team here, we think legislators owe it to the state and the organization to seriously consider it," Morgan said.

Support for the plan eroded when a leaked financial report revealed that despite two losing seasons the Panthers have still taken in million of dollars in profits.

A statewide poll showed that nearly 88 percent of people polled said the Panthers should pay for the renovations with their own money.

"In Buffalo, a major renovation deal was just struck that includes the team putting up $35 million, the county $41 million and the state $54 million, all in return for a tether of only 10 years," Morgan said. "Buffalo and Atlanta have fought for their franchises. North Carolina needs to consider a deal and fight for its franchise as well."

Charlotte City Councilman James Mitchell, Panthers President Danny Morrison, Deputy City Manager Ron Kimble and City Attorney Bob Hageman were on a conference call with members of the Mecklenburg County legislative delegation Friday making a last ditch effort to try and get money approved for the Panthers' upgrades.

Legislative members said the money was just not there in the current political climate.

The rest of the call was spent trying to see if any grants could be won from the NC Department of Commerce to make up the rest of the requested money.

The Panthers are trying to secure the funding to begin the upgrades in January of 2014.

The Greenwich Time reports that Petal, a 6-year-old Rothschild?giraffe?gave birth on Friday to female calf as a group of other?giraffes?and staff at the LEO Zoological Conservation Center watched.

Marcella Leone, founder and director of the center, said the young animal is curious, approaching humans early on in its first days of life.

When fully grown, the newborn, who will mingle with a group of five?giraffes, which includes two pregnant giraffes, could reach 18 feet in height.

The calf is the first born at the off-exhibit conservation center.

Rothschild?giraffes?were named and described by Lord Walter Rothschild, a British zoologist, after an expedition to East Africa in the early 1900s.

Israeli military responds to fire from Syria

JERUSALEM (AP) ? Israel's military says its forces responded to fire from Syria, shooting toward a target across the border.

The military says its soldiers were on routine patrol in the Golan Heights Sunday when they were fired upon. The military did not say what ammunition was fired on either side.

A military spokesman says the soldiers responded with "accurate fire toward the Syrian post from which they were fired upon." He could not say whether regular Syrian forces or rebels fired. He spoke on condition of anonymity because he was not authorized to speak to the media.

Syrian rebels have been moving on and capturing Syrian territory at the foot of the Golan over the past week. Israel captured the strategic plateau from Syria in the 1967 Mideast war.

3rd base coach Mark Berry announces he has cancer | Cincinnati ...

GOODYEAR, Ariz. ? Reds third base coach Mark Berry told the team Sunday morning that he has been diagnosed with cancer, but expressed optimism that he will beat it.

?I have cancer,? Berry told reporters after the team meeting. ?I know it sounds bad, the word cancer, but there are plenty of people in this clubhouse that have had it and I know people around the game who have beaten it. My sister had it and beat it. That part hasn?t bothered me.?

The cancer is on his tonsil and two lymph nodes. Berry has been told the cancer is contained to the left side of his neck and has not spread anywhere else. He has yet to decide between surgery or radiation. He will stay with the team in Arizona over the next week before returning to Cincinnati with the team on Saturday. When he returns, he will have further tests to determine the next step of action. His role with the team going forward is undetermined, but he hopes to continue to stay with the team.

Berry said if he chooses to do radiation, it would be a seven-week treatment, five days a week. In that case, he would be with the team at home, but would not travel.

Reds medical director Timothy Kremchek said the cancer was detected relatively early and the prognosis is positive.

?We?re still waiting on one more test to determine exactly what the cancer is, we have a pretty good feeling about what it is,? Berry said. ?Just to put it out there, exactly what it is, we don?t know yet.?

Berry had a surgery on Wednesday in Cincinnati to take out part of his tonsil, and the cancer was diagnosed from that sample. He had previously had two needle biopsies in Scottsdale, with both of those returning negative results for cancer. However, his sister, Michelle Gonzales, had previously had a similar cancer and also had two needle biopsies that didn?t reveal the disease before later confirming it.

Berry, 50, is in his 30th year in the organization as a player, coach or manager. He has been on the team?s big league coaching staff for the last 15 years, the last 10 as the third base coach.

?I don?t want to down play it, but I?m not concerned,? Berry said. ?I?m going to beat it like lots of people in the game I know (have). They did their treatment and moved on. There?s people in the clubhouse right now that went through it. I don?t see any difference.?

Investing 101: Anatomy of a Bull Market | Breakout - Yahoo! Finance

This weekend marked the four year anniversary of the 2009 market lows, and it comes just days after the Dow Jones Industrials hit new all-time highs. So it seems fitting to assess this historic move and put it into context.

For this edition of Investing 101, we will grab the bull by the horns, and analyze these most lucrative periods of rising stocks that are typically referred to as bull markets.

What exactly is a bull market?

According to Investopedia, "Bull markets are characterized by optimism, investor confidence and expectations that strong results will continue." It's a term that can be applied to any type of securities trading but, the site says, it is most often used to describe the stock market, and is the metaphoric antonym to the term bear market.

How long do bull markets last?

That depends. According to the Stock Traders Almanac the longest bull market we've had since 1900 lasted 2,836 days and ran from October 1990 to July 1998, wracking up a whopping 295% gain for the Dow Jones Industrials along the way. The Almanac says that the shortest bull market in the past 100 years lasted just 61 days during the summer of 1932 yet still saw the Dow bounce 94%! Those are of course the extremes, but the average bull market of the past century has lasted 755 days and delivered an 85% gain. The current bull run is now four years old and up about 120%, making it significantly above average by both measures.

How do bull markets start and end?

"Bear markets begin at the end of one bull market and end at the start of the next bull market," the Stock Trader Almanac states, implying that a cycle change occurs any time the market retreats 20% or more. While bear markets must eclipse this 20% threshold to exist, bull markets have no such requirement, besides the fact that they reside in between these periods of sharp retreat.

Can there ever be a 'bull within a bear' or vice versa?

In short, yes. These shorter term, more customary bull and bear cyclical moves often happen within a much larger and longer secular trend. In fact, there is a debate amongst professionals right now over whether the four-year rally we are presently in is the start of a new mega-uptrend or just a really nice bounce within a much longer slump that began with the bursting of the dot-com bubble 13 years ago. Josh Brown of the Reformed Broker blog recently pointed that "the last secular bear market, from 1966 to 1982" saw investors reap virtually no gains for 16 years. Of course that preceded an enormous 18 year run-up that saw the S&P 500 topping in March of 2000 at levels it still hasn't meaningfully eclipsed today. Should the S&P 500 breakout to new highs then investors will likely acknowledge that a new secular bull market began in March of 2009. Should it falter from it, then the secular bear crowd will need further proof that our downtrend doesn't have further to go.

How did bull and bear markets get their names?

Investopedia says it "comes from the way the animals attack their opponents. A bull thrusts its horns up into the air while a bear swipes its paws down."

Judge nixes NYC?s big drink ban

A New York state judge on Monday threw out a ban on large sugary drinks set to go into effect in New York City on Tuesday, calling the new regulation ?arbitrary and capricious.?

The new regulation?which would have limited the sale of sugary beverages including nondiet sodas, fruit drinks, sweetened teas and other high-calorie drinks to just 16 ounces?was championed by Mayor Michael Bloomberg, who said Tuesday that the city would immediately appeal the verdict. Bloomberg saw the ban as a way to fight the city's growing obesity epidemic.

But the American Beverage Association and other business groups representing bars, restaurants and bodegas had sued to stop the new law, arguing, in part, that it would create an uneven playing field for businesses. The law would have been enforced only on establishments regulated by the city's Health Department, while stores like 7-Eleven, which is regulated as a market by the state of New York, would have been exempt.

In his ruling, New York Supreme Court Justice Milton Tingling agreed with that argument, calling the new regulation "fraught with arbitrary and capricious consequences.

"The simple reading of the rule leads to the earlier acknowledged uneven enforcement even within a particular city block, much less the city as a whole," Tingling continued. "The loopholes in this rule effectively defeat the stated purpose of the rule."

At a news conference, Bloomberg called the judge's ruling "clearly in error." He likened the city's fight against obesity by curbing "empty calories to past regulatory hurdles, including the effort to ban lead paint and the fight to save Grand Central station from demolition in the 1970s.

"We have a responsibility as human beings to do something, to save each other, to save the lives of ourselves, our families, our friends, and all of the rest of the people that live on God?s planet. And so while other people will wring their hands over the problem of sugary drinks, in New York City, we?re doing something about it," Bloomberg declared. "We believe it is reasonable and responsible to draw a line... As a matter of fact, it would be irresponsible not to try to do everything we can to save lives."

In his ruling, Tingling also criticized Bloomberg's decision to implement the ban without a vote of the New York City Council. The regulation was passed into law by a decree issued last September by the city's Health Department. Bloomberg's office had defended the regulation and its passage by arguing that the mayor has a broad mandate to protect and improve the health of New York City residents.

But Tingling was skeptical of that defense, writing that "interpretation" of the law would give the mayor and the city's Health Department the "authority to define, create, mandate and enforce (laws) limited only by its imagination." The regulation, the justice wrote, "would create an administrative Leviathan and violate the separation of powers doctrine. ... It would eviscerate it."

Tingling added: "Such an evisceration has the potential to be more troubling than sugar-sweetened beverages."

In a statement, Michael Cardozo, chief counsel for the Bloomberg administration, said he disagreed with the ruling. "We are confident the Board of Health?s decision will ultimately be upheld. This measure is part of the City?s multi-pronged effort to combat the growing obesity epidemic, which takes the lives of more than 5,000 New Yorkers every year," he said. "We believe the Board of Health has the legal authority?and responsibility?to tackle its leading causes.?

But Matthew Greller, the chief lobbyist of the New York City chapter of the National Association of Theater Owners, which had sued to block the ban, said his group was "elated."

"You can't force people to do things, and that's what today's decision shows. You can't tell people what to drink and where to drink it," Greller said.

As the city prepared to enforce the so-called soda ban, many bars and restaurants complained that city officials had not fully explained how the regulation would be enforced and what drinks were and were not allowed. Meanwhile, some businesses, including the coffee giant Starbucks, said they would not comply because of the pending lawsuit and their belief that most of their products were exempt.

But the ban wasn't unpopular just with businesses. A recent Quinnipiac University poll found that 51 percent of New York City residents polled were opposed to the new regulation.

Chris Gindlesperger, a spokesman for the American Beverage Association, called the judge's ruling a "sigh of relief."

"With this ruling behind us, we look forward to collaborating with city leaders on solutions that will have a meaningful and lasting impact on the people of New York City," he said.

The ruling comes after Bloomberg had successfully championed other controversial health initiatives in the city, including a ban on smoking in bars, restaurants and public parks and a regulation requiring fast food restaurants to post the fat and calorie content of the meals they serve. Last month, he unveiled a plan to ban plastic-foam packaging used for coffee cups and food containers?a proposal that has been popular with New York voters.

But the public never warmed to Bloomberg's soda plan, which he introduced last summer. On Tuesday, the mayor had planned to hold a news conference touting the regulation as a step forward in the city's push to combat obesity, especially among children. But his policy push was halted less than 12 hours before the city was to begin enforcing the regulation.

At a news conference, Bloomberg became annoyed when asked how he had felt about the ruling after spending so much political capital on the issue. He interrupted the reporter mid-question to reject the premise of the inquiry.

"My job is to do the best I can for New Yorkers," Bloomberg insisted. "That includes advising them when science says something that they are doing could be harmful. ... This is not a political capital thing. This is just one human being to another. This is what we have to do."

(AP) ? Adam Jones doubled in the tying and go-ahead runs in the eighth inning, Eric Hosmer had a three-run double in the ninth and the United States beat Canada 9-4 on Sunday to advance to the second round of the World Baseball Classic.

Down to their last several outs, the U.S. trailed 3-2 after seven innings before breaking loose. Team USA and Italy advanced in the group while Canada and Mexico were eliminated.

Jones and Hosmer both had a rough week at the plate but came through with the United States on the brink of what would have been a humbling loss. Jones' hit was his second in nine at-bats. Hosmer was 3 for 13.

Heath Bell pitched a scoreless seventh to get the victory. Jimmy Henderson took the loss.

No timetable for Santana, who could head to DL

PORT ST. LUCIE, Fla. (AP) - It appears more and more likely that Johan Santana will be headed to the disabled list after the New York Mets again pushed back the schedule for their ace to make his spring training debut.

Santana didn't pitch in the major leagues in 2011 following shoulder surgery, then went 6-9 with a 4.85 ERA in 21 starts last year, when he pitched the first no-hitter in Mets history on June 1 against St. Louis. The 33-year-old left-hander didn't pitch after Aug. 17 because of lower back inflammation and did not throw much during the offseason.

The Mets say he doesn't have enough arm strength for exhibition games.

"Right now, it's day to day with Johan," Mets manager Terry Collins said after Saturday's 9-6 win over the Houston Astros. "We certainly would hope something next week, but if it's not, it's not. Again, part of our conversation is, he's ready when he's ready."

Mets general manager Sandy Alderson had said March 2 that Santana needed 10 more days to build up arm strength before he could appear in a spring training game.

Santana did not work out with the team Saturday, instead opting to do more arm and shoulder stretches inside the training complex.

Collins already has looked at the schedule for the first week of the season, which includes a day off on April 2 following the opener against San Diego.

"We've been trying to look down the road," Collins said. "Due to the day off, the one day off, be it the case that Jo is not one of those first five guys, we don't need a fifth guy until the seventh. Again, we're just taking it day by day right now."

If Santana is put on the 15-day DL during spring training, the earliest he could be activated would be April 7.

Mets starter Jeremy Hefner could be a beneficiary of Santana's health issues and take over a starting slot early in the season. Hefner allowed one hit in three scoreless innings against Houston.

"The last couple outings, continuing back to about his last two or three starts last year, he's been outstanding," Collins said. "His command has been very good, his change of speeds have been good; he's done a nice job. Certainly coming into this camp, in a lot of people's minds, he was our No. 6 guy. Certainly he's going to continue to pitch and if we need a guy, we know he's going to be ready."

Hefner is not preparing any differently because of Santana's arm issue.

"Obviously it hinges on Johan, how he feels and that type of thing," Hefner said. "I only can control me, my approach and my bullpens and that's what I'm going to continue to do and let Johan rehab and continue to do what he needs to do to pitch. I go into every spring hoping to make the big league team and that didn't change this offseason, this spring. That's the ultimate goal and whatever happens will happen."

Hefner, who threw two more simulated innings after leaving Saturday's game, got help from center fielder Matt den Dekker, who made a sliding grab on the warning track of Trevor Crowe's long fly ball in the third inning, catching the ball in the webbing of his glove.

Lucas Duda and John Buck drove in two runs each and Ike Davis scored three times. Duda went 3 for 3 with a double, while Buck had two hits and increased his spring training RBIs total to seven. Davis was 2 for 2 with a walk, stolen base and a RBI.

Duda, who has been working on a new swing this spring, went 3-for-3 with a double. Collins said he can see Duda starting to get into a rhythm at the plate.

"I feel good," said Duda, who has changed the mechanics on his swing. "I'm working hard every day. I'm working hard with my swing every day, trying to get better. (This) is just one day. I'll just continue to work hard in (batting practice)."

Houston's Carlos Pena hit a two-run homer in the fourth. Astros starter Alex White gave up four runs and five hits in 2 2-3 innings.

"I threw a lot of strikes, made some really good pitches, gave up some hits that were not hit really well and that's going to happen," White said. "I threw a lot of strikes, that's a big key for me. I feel good about the outing. Obviously, the numbers aren't what I want them to be, but, once again, it's a little early."

NOTES: Astros RHP Lucas Harrell will not make his scheduled start against the Phillies on Sunday due to discomfort in his right groin. Houston manager Bo Porter said Harrell likely would have pitched during the regular season. ... Astros LHP Eric Bedard (right glute) threw off a mound. He has not pitched since his spring training debut on Feb. 26. ... Collins said CF Kirk Nieuwenhuis (knee) could play Wednesday and 2B Daniel Murphy (strained intercostal muscle) could make his spring training debut next week.
