Considering The Immediate Aftermath | Nirenstein, Horowitz ...

Jul 30, 2012 ?/? By: Barry D. Horowitz, Estate Planning Attorney ?/? Category: Estate Planning

Estate planning has everything to do with providing for the well-being of your loved ones. At first glance this can seem like a purely financial endeavor, and of course this is a very large part of it. But it is also useful to ask yourself exactly what your family will be going through at the time of your death.

If you do not make plans in advance, one of the responsibilities that will fall into their laps will be the matter of making final arrangements. This is more difficult than it may sound on the surface. For one thing, when you are grieving you are really not in the mindset to drive around town trying to find the right resources.

And for another, there a lot of decisions that must be made, and who is to say what you would have preferred if you do not make your preferences known?

In addition to the simple fact that tasks must be undertaken without any guidance, family members can often disagree with regard to the correct course of action. This is a time when your loved one should be pulling together as a family and acrimonious interactions can make a very challenging situation all the worse.

The wise course of action is to assert your funeral preferences in advance. If you are interested in doing so, right now would be a good time to set up an appointment with a good Hartford estate planning attorney to set the wheels in motion.

Surface to arrive with Windows 8 on 10/26, says Microsoft

Though it's not exactly an earth-shattering revelation, Microsoft has confirmed that Surface tablets will arrive October 26 along with Windows 8.

"The next version of our operating system, Windows 8, will be generally available on October 26, 2012. At that time, we will begin selling the Surface, a series of Microsoft-designed and manufactured hardware devices," Microsoft said in its annual report filed this week with the U.S. Securities and Exchange Commission.

Microsoft has said before that Surface products "would be available the same time that Windows 8" was launched, but it's reassuring to see the date in writing.

And, remember, those are Windows RT tablets only. The Intel-based Surface Pro is expected about 90 days later, according to Microsoft.

Microsoft has also peppered disclaimers throughout the annual report (these appear often in SEC filings) about the success, or lack thereof, of Windows 8.

In fall 2012, we are launching Windows 8...Its success depends on a number of factors including the extent to which customers embrace its new user interface and functionality, successfully coordinating with our OEM partners in releasing a variety of hardware devices that take advantage of its features, and attracting developers at scale to ensure a competitive array of quality applications. We expect to incur substantial marketing costs in launching Window 8 and associated services and devices, which may reduce our operating margins."

That last part about "may reduce operating margins" is something Wall Street will of course be watching closely. In short, if Windows 8 is not relatively successful, this may fuel doubts about Microsoft's viability in the age of the iPad and Android.

The Surface products will be offered in basically two forms. One is expected to be a more price-friendly version running Windows RT on top of ARM chips. The other, likely a bit pricier, will run Windows 8 Pro on top of Intel "Ivy Bridge" processors.

And pricing? While there's a lot of whacky speculation about sky-high pricing, Microsoft's own guidance portends a more rational pricing scheme.

"Suggested retail pricing will be announced closer to availability and is expected to be competitive with a comparable ARM tablet or Intel Ultrabook-class PC," Microsoft said in a statement.

Based on that statement, a back-of-the-envelope estimate could put -- the operative word here is "could" as this is simply speculation -- Windows RT products as low as $500-$600 and Windows 8 Pro Intel-based products ranging up to $1,000, or possibly higher.

That said, Microsoft's pricing plans are undoubtedly in a state of flux, and we won't know until the company tells us.

Nelinia (Deallo) Vs Al'mayaz (TheNoremac42)

Today was the second day of the Spring equinox.

The sun was directly overhead the monk's brow, hot enough to make any traveler weary if she hadn't taken refuge in the shade of the forest, walking in a quite pleasant temperature. The truth, however, was that the monk was paranoid and righteously so. It was the first time that Nel had left the monastery on her own accord, even after two days since her abandonment, she couldn't help but twist her head around every five seconds and jumping after every little sound the forest had to offer.

If only the others would have joined her; she wouldn't be in this mess. Yet the other monks hadn't. The rumors of the king's untimely illness had spread like wildfire from the capital, reaching far and wide, to the steps of Nel's own home. At first, it was to be dealt with as rumors are, to be taken with a grain of salt. However, as more time passed, loose lips bear more tales. One in particular was about the prince's request for adventurers; aid of an artifact that could help his ailing father. The argument began when the woman inquired about it with fellow monks, friends she had grew up with since she was just a child, friends which she had trained rigorously with in body, mind, and spirit, thought it to be an unnecessary endeavor. Everyone is destined to die and all attempts to deny that simple truth will lead to failure.

Nel left on that night, sneaking out the front door, to do what is right. She wasn't the only monk who knew the importance of a leader but the only one who hadn't feared (at that moment in time) the outside world. A world riddled with vice. Murder, thievery, and deception.

Even while the sun was out, she was conscious of her surroundings, jittery to onlookers if there were any. As I mentioned before; it was necessary. She was clad in bright yellow monk robes which stopped at her knees and held a quarterstaff in her right hand. It would take no master tracker to spot her in the landscape, a forest with sand for soil, small little sprouts littered across the sand among the toughest of trees that survived and grew to great heights. It would take no master swordsmen to end her, the wooden staff no match for a a cold, steel weapon. As it would seem anyway. She had nothing else besides three copper coins and a small metal begging bowl that was dug in her chest.

To merely assume things, however, is an excellent way to die.

The bandages wrapped around her calfs, the midsection of her feet, forearms and knuckles were of no injury. The edges of her robes were purposefully tucked in these bandages; ready for combat. A precaution. Her steps, light and graceful, petite body, a very misleading and dangerous weapon.

Her paranoia suddenly put her on edge, having thought to hear another sound, she turned around, pulled down her hood to clear her peripheral vision, revealing her black shoulder-length hair tied back with twine, and took a fighting stance. The left leg was back, bent low, Nel's body leaned back entirely on the left leg while her right leg was straight and practically weightless. By her chest, the staff was gripped with her right hand by the center and the lower half with her left, leaving the front half pointed upwards, spanning four and half feet of reach.

Nel's emerald eyes peered into the forest, hoping she was indeed wrong like the day before, and she called out:

"Come out! I know you're there!"

Immediately greeted by her own echo, she waited, bound to let eventually turn away if there wasn't a true presence afoot...

Olympic viewing: NBC critics loud on social media

NEW YORK (AP) ? In the age of social media, NBC now has millions of television critics who make their opinions known about every aspect of Olympics coverage instantly.

They've even set up their own hashtag on Twitter: (hash)nbcfail. The online complaints focused Saturday on NBC's decision to air the marquee swimming event won by American Ryan Lochte on tape delay in prime time, and Friday on the network not streaming the opening ceremony online. Sunday's critics started early: people wondering why the U.S. men's basketball team's opening game aired on a cable network while women's cycling was shown on NBC.

The conversation is so active that NBC's executive producer of the games, Jim Bell, took to Twitter to answer critics and even change the way NBC is doing something in response.

"(hash)nbcfail is filled with a lot of crying and snark and humor, but NBC can actually learn something from it," said Jeff Jarvis, a media critic who writes the Buzzmachine.com blog.

Complaints about tape delayed coverage are an evergreen with Olympics held on foreign soil. But the London Games are the first with Twitter, Facebook and other social media sites in full flower, in a mobile phone era where people carry computers that instantly deliver news in their pockets. It has amplified the impatience of viewers who want to see events on their large-screen TVs instantly and haven't been mollified by NBC's decision to stream the events live online.

James Poniewozik, Time magazine TV critic, tweeted that "NBC tape delay coverage is like the airlines: its interest is in giving you the least satisfactory service you will still come back for."

That drew a quick response from NBC's Bell: "You do know that all sports events are being streamed live right?"

"I do, indeed!" replied Poniewozik. "Have enjoyed it. Apparently a lot of folks still prefer watching it on TV."

NBC says it saves big events for prime-time airing because that is when most viewers are available to watch them and where the network makes the bulk of its advertising revenue. Since prime time on the U.S. East Coast coincides with 1 a.m. London time, there are no events to air live then. NBC representatives noted that there were 39 hours of live events Sunday on NBC and its affiliated networks.

Jonathan Wald, who produces Piers Morgan's CNN talk show and used to work at NBC, tweeted that "the medal for most Olympic whining goes to everyone who complains about what happens every four years. Tape delay."

One of those complainers, in fact, was Morgan: He tweeted his disdain Friday for NBC's decision not to make the opening ceremony available live.

The advent of Twitter makes it seems like there's a lot of unhappiness when the majority of viewers are watching NBC on tape delay and appear satisfied with it, Wald said in an interview.

NBC can point to television ratings justifying their approach. The Nielsen company said the opening ceremony drew more than 40 million people Friday, the most ever for one of those Olympic events. Saturday's first night of coverage was seen by 28.7 million, another record, beating every other first night of Olympic competition. In Beijing four years ago, 24 million watched on the corresponding night.

Jarvis said he believes NBC could satisfy fans by, for example, televising events like Lochte's race live in the afternoon and then repeating it at night. He acknowledges, though, that he's not the one who'd potentially be risking millions of dollars in advertising revenue if such a decision cut into prime-time viewing.

NBC has tried to "hold on to old media strategies in a new media world," Jarvis said. "And that's a mistake."

Some of the online complaints seem to take special glee in bashing NBC, with a few describing it like an Olympic sport of its own. Some are quite personal, like the CNN producer who tweeted Sunday: "No USA basketball in my hotel room. Why they aren't putting it on NBC's main channel is beyond me!"

Bell, in some of his back-and-forth with online critics Sunday, answered one tweeter who described herself as a St. Louis mom and complained about NBC's "Nightly News" on Saturday airing results of events that hadn't been shown on the network yet. Bell tweeted that he'd look into it, and shortly after told her that "Nightly News" would announce a "spoiler alert" to tell people to avert their eyes if they didn't want to see results.

Not everyone online is a critic. On Sunday, the U.S. Olympic sailing team tweeted that it was "by far the greatest sailing TV coverage in Olympic history."

Sharp Aquos SH10D makes pit stop at FCC, earns stamp of approval

NTT DoCoMo announced a roster of phones this past May, and among them was Sharp's Aquos SH-10D. After spending some quality time with the FCC, the handset now has paperwork that could allow it to travel stateside. Along with a quartet of oddly angled corners, the phone packs a GSM and HSPA+ / WCDMA radio, 4.5-inch screen, 1.5GHz dual-core processor, 12.1 MP rear-facing camera and a 0.32 MP frontward-facing cam for those awkward, Facebook-bound self-portraits. Hit the link below if you'd like to rifle through the FCC results yourself.

Ex-skeptic: Humans cause global warming

By NBC News

Dan Tuffs / Getty Images file

Richard Muller, physics professor, is chair of the Berkley Earth Surface Temperature project.

Global warming not only is real, but "humans are almost entirely the cause," a self-described former climate change skeptic has declared.

"Call me a converted skeptic," Richard A. Muller, University of California, Berkeley physics professor said in an opinion piece posted online Saturday in The New York Times.

Muller in October released results from the Berkeley Earth Surface Temperature (BEST) project, set up for global warming skeptics, that showed that since the mid-1950s, global average temperatures over land have risen by 0.9 degrees Celsius (1.6 degrees Fahrenheit).

In his new statement, Muller said, "Last year, following an intensive research effort involving a dozen scientists, I concluded that global warming was real and that the prior estimates of the rate of warming were correct. I?m now going a step further: Humans are almost entirely the cause."

He credited his turnaround to "careful and objective analysis" by BEST, explaining:

?Our results show that the average temperature of the earth?s land has risen by two and a half degrees Fahrenheit over the past 250 years, including an increase of one and a half degrees over the most recent 50 years. Moreover, it appears likely that essentially all of this increase results from the human emission of greenhouse gases. These findings are stronger than those of the Intergovernmental Panel on Climate Change, the United Nations group that defines the scientific and diplomatic consensus on global warming. ... ?

Money for the BEST study came from five foundations, including one established by Microsoft founder Bill Gates and another from the Charles Koch Charitable Foundation, set up by the billionaire coal magnate and widely seen as a source of money for conservative organizations and initiatives that have fought efforts to curb greenhouse-gas emissions.

Muller's website says the BEST findings will be released Monday.

Muller said in his opinion piece he remains skeptical of some climate-change claims.

"Hurricane Katrina cannot be attributed to global warming. The number of hurricanes hitting the United States has been going down, not up; likewise for intense tornadoes. Polar bears aren?t dying from receding ice, and the Himalayan glaciers aren?t going to melt by 2035."

Phelps, Park, Biedermann among swim surprises

(AP) ? Michael Phelps barely qualified in the 400-meter individual medley on the opening day of Olympic swimming Saturday, squeaking into the final by seven-hundredths of a second.

"That one didn't feel too good," he said.

Phelps wasn't the only surprise of the morning at the Aquatics Centre, where Queen Elizabeth appeared briefly.

Olympic champion Park Tae-hwan of South Korea won his 400 freestyle heat, but was disqualified for a false start. Paul Biedermann of Germany, the world record holder in the event, failed to make the final.

"That's the Olympics," said Canadian Ryan Cochrane, who barely made the 400 free final. "It's always a surprise, every single heat. You just have to focus on your own race."

Phelps, the two-time defending Olympic champion, won his 400 IM preliminary heat in 4 minutes, 13.33 seconds with a time that was well off his world record of 4:03.84 set four years ago in Beijing, when Phelps won a record eight gold medals.

But it was only good enough to secure the last spot in the evening final, when Phelps will swim in Lane 8 instead of the middle of the pool.

"The only thing that matters is just getting a spot in," he said. "You can't win the gold medal from the morning."

In the 400 IM, Kosuke Hagino of Japan led the way in 4:10.01, a national record. Chad le Clos of South Africa was second at 4:12.24, and Ryan Lochte of the United States advanced in third at 4:12.35.

Phelps' time was just fast enough to keep Laszlo Cseh of Hungary, the silver medalist in Beijing, out of the final. Cseh was ninth overall after leading Phelps during their heat before the American closed on the last lap of freestyle to beat him to the wall.

"I didn't expect those guys to go that fast in their heat," Phelps said. "I was slower this morning than I was four years ago."

Phelps' time in the grueling event that he had vowed not to swim again after Beijing took some of the luster off what was expected to be a showdown between him and Lochte for gold.

"You can't count him out," Lochte said of Phelps. "Even though he just squeaked in eighth, he's a racer. We're going to do everything we can to go 1-2 tonight."

Lochte, the bronze medalist in Beijing, has won the 400 IM at the last two world championships.

"My first race is always the worst one," he said. "I'm glad I got the cobwebs out."

Dana Vollmer had the fastest qualifying time in the 100 butterfly at 56.25 seconds, setting American and Olympic records, to lead 16 women into the evening semifinals.

"I'm really happy with how fast it was and I think it's only going to get faster," she said. "That's kind of a confidence-booster. I'm ready to go."

Lu Ying of China was second in 57.17 and Australian Alicia Coutts was third at 57.36. Sarah Sjostrom of Sweden, the world record holder, was fourth at 57.45.

American Claire Donahue moved on in seventh, while British teammates Francesca Hall and Ellen Gandy were eighth and ninth.

Jess Schipper of Australia, the bronze medalist four years ago, was 24th and missed the semifinals by eight spots.

In the 400 free, Sun Yang of China qualified fastest in 3:45.07. American Peter Vanderkaay was second at 3:45.80, followed by his teammates Conor Dwyer in 3:46.24.

Park was surprised by his DQ, saying, "I don't know why" after he walked off the deck. In Beijing, he became South Korea's first swimming gold medalist and then won the world title in Shanghai last year.

Biedermann washed out for the second straight Olympics. He didn't make it out of the heats in Beijing. He set the world record at the 2009 world meet in Rome at the height of the high-tech body suit craze. Those suits have since been banned.

Syria rebels fend off Aleppo assault

Syrian rebels staved off a fightback by regime forces in Aleppo on Saturday amid growing concern about the risks of reprisals against civilians in the country's commercial capital.

After massing for two days, troops backed by tanks and helicopter gunships moved on southwestern Aleppo where rebels concentrated their forces when they seized much of the northern city on July 20.

At least 29 people were killed, the Syrian Observatory for Human Rights said, contributing to a figure of at least 111 people nationwide.

The watchdog said more than 20,000 people, the majority civilians, have now died since the uprising against President Bashar al-Assad's regime erupted in March 2011.

"It started at 4:00 am (1:00 GMT) and eight hours later it's still hell. This is madness," an AFP correspondent reported from the Aleppo district of Salaheddin.

Civilians crowded into basements seeking refuge from the bombing, with the Observatory's Rami Abdel Rahman describing the clashes as the uprising's "fiercest."

"There are thousands of people in the streets fleeing the bombardment. They're being terrorised by helicopter gunships flying at low altitude," said an activist, adding many had taken refuge in public parks.

Official news agency SANA reported fighting in Furqan district where "a terrorist group was terrorising residents."

It said two "terrorists" had been killed and three others captured, and their arms and vehicles seized.

Colonel Abdel Jabbar al-Oqaidi of the rebel Free Syrian Army said his forces had repulsed troops in Salaheddin and that the regime offensive had been stopped.

"We managed to force the army to the neighbourhood of Hamdaniyeh," he told AFP on the phone, adding that while the army had been halted on the ground, artillery and gunships continued to pound the city.

Abdel Rahman said the fact the soldiers had been stopped in Salaheddin "does not necessarily mean a withdrawal as their strategy is to bombard ... to cause an exodus then launch an assault even more fierce."

An AFP correspondent said rebels were poised to launch a final raid on a strategic police post in the city centre, where 100 men armed with Kalashnikovs have been holding out for three days.

Its capture would open a corridor between Salaheddin and the rebel-held district of Sakhur, some six kilometres (four miles) to the northeast.

Pro-government daily Al-Watan had warned the "mother of all battles" loomed in Aleppo as the government moved to reassert its authority after recapturing rebel-held districts of Damascus.

Both sides acknowledged casualties were likely to be high, and world powers have called for "maximum pressure" to stop the regime from carrying out the assault and to avert another massacre.

In late May, at least 108 people were killed near the central town of Houla, the United Nations said. On July 12, regime forces killed more than 150 people in the central village of Treimsa, the Observatory said.

Russia warned a "tragedy" was looming but said it was unrealistic to expect the government would stand by when rebels were occupying major cities.

"We are persuading the government that they need to make some first gestures," said Foreign Minister Sergei Lavrov.

"But when the armed opposition are occupying cities like Aleppo, where yet another tragedy is brewing as I understand ... it is not realistic to expect that they will accept this."

Lavrov accused the West of aiding opposition fighters.

"Our Western partners ... together with some of Syria's neighbours are essentially encouraging, supporting and directing an armed struggle against the regime."

"The price of this is yet more blood," he said.

Russia has repeatedly rejected accusations it is backing Assad's regime in the conflict, claiming to have an even-handed approach while rebuking the West for siding with the rebels.

Lavrov added there were meetings planned in the near future with Syrian rebels "in Russia and foreign countries where these boys are based," and that the point driven home would be "that if it is a revolution, they must not seek the backing of the UN Security Council".

Asked later if Russia would provide Assad with asylum, he said: "We are not even thinking of that," Russian news agencies reported.

French President Francois Hollande specifically addressed Russia and China as he urged the UN Security Council to rapidly intervene to pre-empt an all-out civil war in Syria.

Hollande said Assad's regime was doomed and "will therefore use force right to the end."

"The only solution which will allow Syrians to reconcile and reunite is the departure of Bashar al-Assad and the formation of a transitional government," he told reporters.

"It is not too late but with every passing day it's more repression, upheavals and consequently massacres."

Turkey warned it could "not remain an observer" as violence raged across its southern border.

"We must do what we can together in the United Nations Security Council, and also in the Organisation of Islamic Cooperation and the Arab League, to make sure that we can make some important progress in trying to avert this appalling situation," said Prime Minister Recep Tayyip Erdogan.

1 shooting victim, 2 donation sites: Where to give?

www.farrahsoudani.com

The Farrah Soudani Fund website was set up by her family to raise money for a disability trust for the woman who was wounded in the Aurora, Colo. theater shooting.

?

By Isolde Raftery, NBC News contributor

?In the days following the deadly shootings in Aurora, Colo., two sites soliciting donations were created for Farrah Soudani, a 22-year-old whose spleen and kidney were removed after she and dozens of others were shot in a movie theater during the midnight showing of ?The Dark Knight Rises.?

The first was set up on gofundme.com by a friend of Soudani?s mother who pledged that all the money would go to Soudani. By Thursday evening, the site had raised more than $143,000.

But Soudani?s family on her dad's side worried about where that money would end up. They didn?t know this woman well, her brother Jordan Soudani said. Marty Soudani, a business owner, argued that a disability trust should be set up for his younger cousin, to protect her from creditors.

?We don?t know if that fund is going to go 100 percent to her,? Marty Soudani said. A trust would be more secure, he said; if Soudani, who does not have health insurance, went bankrupt, he said, creditors wouldn?t be able to touch the trust money, which could help to cover long-term care.

Woman survives theater shooting thanks to her boyfriend's father

The Soudani family, which has raised about $10,000 for the Farrah Soudani Fund, has asked those handling the gofundme.com site to transfer the donations to the trust. But so far, the family said, they have remained noncommittal. Those handling the gofundme.com site did not reply to a message from NBC News sent through the donation site.

Nearly a week after the shooting at an Aurora, Colo., movie theater left 12 dead and 58 injured, the survivors and their families are struggling with growing medical bills. Rock Center Correspondent Kate Snow talks to the survivors' families and their doctors.?

Victoria Albright, who manages the site, wrote to skeptics: ?I will see that these funds are never manipulated, or land in the wrong hands. This is ALL about Farrah and her recovery. Promise!?

?We?re not saying they?re thieves,? Marty Soudani said, ?but they?re not working with the family.?

Soudani isn?t alone in being wary of outsiders? zeal to raise money. Such an instinct has become a natural response from outsiders, who want to help but can?t be on site.

Ken Berger ??president and CEO of?Charity Navigator, a non-profit charity watchdog group?? told NBC?s Technolog that he advises caution.

gofundme.com

A website set up by a friend of Soudani's mother has raised more than $143,000.

"Disasters are a time when people run into a situation where they, to some degree, are flying blind because the charities they know?? the ones they typically give to?? may not be providing services in the area,? Berger said. ?So it's a time that scammers are likely to prey on people.?

Anticipating this, Colorado Gov. John Hickenlooper encouraged people to give through GivingFirst.org, which raised nearly $2 million by Thursday. There, donors can choose a specific nonprofit ? Aurora Mental Health Center or Denver Center for Crime Victims, for example ? or ask that their money go wherever deemed necessary. The University of Colorado Hospital Foundation has also solicited donations for a 7/20 Victims Fund to help cover care of those shot in the early hours of July 20.

Still, for those whose loved ones remain hospitalized, their bills soaring, raising money through sites such as PayPal or wepay.com has immediate appeal. A fund for Caleb Medley, who was in a medically induced coma while his wife gave birth to their son, Hugo, had $330,000 by Thursday evening. Medley does not have health insurance, according to the site.

The site says Medley and his wife ?need help covering their medical bills (which will no doubt be in the hundreds of thousands if not millions of dollars), cost of living, baby supplies, and maybe even a college fund for Hugo! They need our help!?

But officials warn that a significant influx of cash could mean the victims are no longer eligible for certain social services, such as Medicaid, which covers long-term care for low-income people. ??

Watch the most-viewed videos on NBCNews.com

?If you give to an individual, it?s not tax deductible and it can affect the long-term security of those folks,? said Dana Rinderknecht, manager of online giving at GivingFirst.org. ?They can lose some services.?

Rachel Reiter, a spokeswoman for the Colorado Department of Health Care Policy and Financing, emphasized that Medicaid is determined on a case-by-case basis but said income is one of the factors considered.

Reiter said state workers are helping families figure out if they qualify for aid, particularly if they have long-term needs. Medicaid helps to cover the medical care of families, children, pregnant women and people with disabilities. ?

?Giving through a nonprofit is strongly encouraged,? Reiter said in an e-mail. ?For individuals who are disabled, excess funds may be placed in a Disability Trust and the funds would not be counted against the individual. We have staff working with the hospitals and families where this may be an option.?

Christine Handel, a Soudani family friend who helped to create the trust site, described raising money in the wake of such a tragedy as ?navigating a minefield.?

?There?s no roadmap for this when these things happen,? Handel said. ?It?s not that people have bad intentions ? they don?t have knowledge. We don?t want Farrah to worry about tax season next year. She needs to go to her appointments and see her doctors and get better.???

Nintendo explains how it tests a DS ? Video Games Reviews ...

Having owned several generations of gaming hardware, my Nintendo devices always seem to be the most hard wearing. That comes down to a combination of great design and thorough testing, and Nintendo has decided to share some of the tests it puts hardware through to ensure it wont break in the sweaty hands of a gamer.

As part of the company?s 2012 consumer report, Nintendo has posted seven pictures along with a summary of the tests it carries out on the Nintendo DS. These are sure to be just a few of the multitude of tests the device has to pass, but it does demonstrate how tough the DS has to be.

As you?d expect, Nintendo tests the strengthof the keys with a button striking durability test. The exterior surface is checked for wear with a rubbing test, the hinges are tested for performance by repeatedly opening and closing them, and even the wiring is tested for strength by bending it and checking for stress.

The final test detailed on the actual hardware itself is the drop test. The height of the drop isn?t specified, but based on the image, it looks to be about a meter above the ground.

Nintendo also extends testing to product packaging so as to keep the DS safe during transport. The two tests detailed include vibrating a box full of devices on a vibration plate, probably to simulate transport on a truck and poor road surfaces. These boxes will also be stacked, so Nintendo squashes them with a predetermined force equaling the maximum stack height shipping allows in either a container or vehicle.

Beyond that, Nintendo carries out a number of temperature and humidity tests to ensure heat, cold, and moisture don?t impact the electronics and result in a faulty device.

The hardware used in the tests will never make it to retail. Nintendo will just regularly pick final hardware from the production line and carry out the tests to ensure a high quality product is shipping out.

Katherine Jackson Removed As Guardian of Michael Jackson's Children

Cousin TJ Jackson is appointed temporary guardian of Michael's kids.
By Gil Kaufman

<P>The unpredictable wheel of Jackson family drama continued to spin on Wednesday (July 25) when a judge stripped family matriarch Katherine of her guardianship of the late King of Pop Michael's three children, handing over the duties to their cousin, TJ Jackson.</P><P>After nearly a week of increasingly bizarre public feuding, accusations, <a href="http://rapfix.mtv.com/2012/07/25/fight-details-janet-and-paris-jackson/">confrontations</a> and <a href="http://rapfix.mtv.com/2012/07/24/fight-between-janet-and-paris-jackson-kidnapping-allegations/">allegations of kidnapping</a>, <a href="http://www.tmz.com/2012/07/25/jackson-family-emergency-guardianship-hearing-katherine-jackson-tj-randy-michael-jackson-kids-custody/" target="_blank">TMZ</a> reported that Judge Mitch Beckloff temporarily stripped Katherine of her guardianship over Paris, Prince and Prince Michael II ("Blanket").</P><P>He appointed TJ, 34, son of Tito Jackson, as the new guardian for the children, who appear to be at the center of a tug-of-war between the Michael's adult siblings. During an emergency guardianship hearing, Beckloff did not suspend Katherine for any wrongdoing, but said that she was being blocked from carrying out her guardianship by unnamed third parties, which the site speculated were siblings Randy, Janet, Jermaine and Rebbie.</P><P>Beckloff reportedly advised TJ and his lawyer to seek a permanent guardianship agreement following stories that Katherine, 82, was being held against her will by the same unidentified "third parties." During the hearing, TJ's lawyer described to the judge a strange phone call his client got from Katherine on Tuesday. "I've never heard my grandmother talk like that," TJ said, adding that she didn't sound "sharp" and that her "pauses, choice of vocabulary ... she has not used certain phrases like that before." He suspected she was talking in code.</P><P>Katherine Jackson called home on Tuesday after being out of touch for nine days, according to her lawyer. She had asked TJ to watch the children for her when she left her home on July 15.</P><P>In an unexpected twist, TMZ reported that one of Katherine's own lawyers, Sandra Ribera, said she had visited the family compound recently and also believes that her client is being held against her will. Katherine's other lawyer, Perry Sanders, said in court that he vigorously opposes a permanent move to strip Katherine of her guardianship and that when she returns to Los Angeles he will file a motion to reinstate her as guardian. <a href="http://www.cnn.com/2012/07/25/showbiz/jackson-family-dispute/index.html" target="_blank">CNN</a> reported that after the hearing Sanders said he'd been informed by Randy Jackson that his mother was on a plane headed back to California.</P><P>Sanders also said the Tuesday night check-in call from Katherine was made after she met with Jermaine and Janet Jackson at a spa near Tucson, Arizona. He was barred, however, from meeting with her or talking to her at that time.</P><P>The judge also ordered that the children not be removed from California without a court order and that backup guardian Diana Ross and Debbie Rowe, biological mother of the two oldest children, also be informed of the order to keep the kids in the state. The move to wrestle guardianship away from the family matriarch was days in coming and allegedly supported by the children, as well as MJ's estate. A spokesperson for the estate had no comment on the actions at press time.</P><P>The temporary guardianship will be reviewed at a hearing scheduled for next month, where it's possible that Wednesday's action could be reversed.</P><P>While Michael's will gave Katherine custody of his children and a 20 percent stake in his massive estate, her husband, Joe Jackson, and the eight surviving Jackson siblings were completely cut out. Some of the siblings have reportedly been exploring a move to have the will invalidated by arguing that Michael was in New York on the day that the document was notarized in Los Angeles.</P><P>In a video that surfaced earlier this week, Janet Jackson is seen trying to take a cell phone away from Paris, 14, and berating her niece for using her phone to tweet about family business. That video leaked after Janet, Jermaine and Randy Jackson reportedly attempted to persuade Paris and Prince, 15, to leave Katherine's home on Monday. Both resisted and a short time later, sheriff's deputies arrived to break up a scuffle between Randy, Jermaine Jackson and TJ.</P><P><a href="http://rapfix.mtv.com/2012/07/24/fight-at-michael-jacksons-mother-house-police-called/">MTV News</a> reported that police were called to the scene but did not make any arrests. </p>

Brief Introduction to Online LPN Classes

It is a must for every student who is interested in online LPN program to choose a good and reputable online school and not an institution that just creates diplomas which could attract too much attention from the professional people. For that, students must inquire thoroughly about the clinical or practical experience details, fees and available financial aids for a specific LPN program online. You should also examine their accreditation status by checking whether it is accredited by the Board of Nursing of the state. This helps you to get training from licensed and accredited online program. Visit our website for more details on CNA schools in Arizona.

White House: Obama not seeking new gun laws

(AP) ? Even as the issue of guns shifts to the forefront of the presidential campaign, the White House and the Senate's top Democrat made it clear Thursday that new gun legislation will not be on the political agenda this year. Instead, President Barack Obama intends to focus on other ways to combat gun violence ? a position not unlike that of his rival, Mitt Romney.

Days after the mass shootings in Colorado, White House spokesman Jay Carney said Obama still supports a ban on the sale of assault weapons, a restriction that expired in 2004. But he added: "There are things we can do short of legislation and short of gun laws that can reduce violence in our society."

Carney's comments came the day after Obama, in a speech to an African-American group Wednesday in New Orleans, embraced some degree of additional restrictions on guns. He acknowledged that not enough had been done to keep weapons out of the hands of criminals and pledged to work with lawmakers from both parties to move forward on the matter.

Carney also spoke as a prominent gun control group called on Obama and Romney to lead a search for solutions to gun violence. The Brady Campaign to Prevent Gun Violence said both candidates owe voters concrete plans and appealed to them not to duck the issue.

In the Senate, Majority Leader Harry Reid said Thursday that the Senate would not consider the gun issue this year, even though he agreed with Obama's remarks in New Orleans.

"With the schedule we have, we're not going to even have a debate on gun control," Reid told reporters.

The White House and Reid's stance illustrate a reality in Washington, where advocating for restrictions on gun ownership is viewed as a political liability.

Acknowledging opposition in Congress to new limits, Carney said Obama will work to enhance existing gun laws.

"While there is that stalemate in Congress there are other things we can do," he said.

Obama told the National Urban League in New Orleans that he was willing to work with both parties in Congress to find a national consensus that addresses violence. That speech came six days after the shooting in an Aurora, Col., movie theater that left 12 people dead and injured dozens more.

In an interview Thursday with CNN, Romney said new laws won't keep people from carrying out "terrible acts." He cited the case of Timothy McVeigh, who was convicted and put to death for the 1995 bombing of a federal building in Oklahoma City that killed 168 people.

"How many people did he kill with fertilizer, with products that can be purchased legally anywhere in the world? He was able to carry out vast mayhem," Romney said. "Somehow thinking that laws against the instruments of violence will make violence go away, I think is misguided."

In a separate interview Wednesday, Romney said many weapons used by the shooting suspect in Aurora, Colo., were obtained illegally, though authorities have said the firearms used were purchased legally.

"The illegality the governor is referencing is the ordinances, the devices that were in the home," said campaign spokesman Danny Diaz. "He was not referencing the weapons carried to the theater."

Obama called for stepped-up background checks for people who want to buy guns and restrictions to keep mentally unbalanced individuals from buying weapons. He said those steps "shouldn't be controversial."

Despite the Second Amendment's protection of gun rights, Obama said: "I also believe that a lot of gun owners would agree that an AK-47 belongs in the hands of soldiers, not in the hands of criminals ? that they belong on the battlefield of war, not on the streets of our cities."

Neither candidate strayed significantly Wednesday from previously held positions on gun violence. But their pointed comments revived a debate ? if perhaps only briefly ? that has steadily faded to the background in national politics and been virtually non-existent in the 2012 campaign.

The White House in particular has faced fresh questions since the shootings about whether Obama, a strong supporter of gun control as a senator from Illinois, would make an election-year push for stricter measures.

Following last year's killing of six people and the wounding of then-Rep. Gabrielle Giffords in Arizona, Obama called for steps to "keep those irresponsible, law-breaking few from getting their hands on a gun in the first place." But he has advanced no legislative proposals since then.

It's been more than a decade since gun control advocates had a realistic hope of getting the type of legislation they seek, despite predictions that each shocking outburst of violence would lead to action.

In his remarks, Obama acknowledged a national pattern of calling for tougher gun restrictions in the wake of violent crimes but not following through.

"Too often, those efforts are defeated by politics and by lobbying and eventually by the pull of our collective attention elsewhere," he said.

Romney was pressed on gun control during an interview with NBC News in London, where he is attending the Olympics and kicking off a three-country foreign trip. The presumptive Republican nominee said changing laws won't "make all bad things go away."

Romney was asked about his tenure as Massachusetts governor, when he signed a bill that banned some assault-style weapons like the type the Colorado shooter is alleged to have used. At the time, Romney described such guns as "instruments of destruction with the sole purpose of hunting down and killing people."

Asked if he stood by those comments, Romney mentioned the Massachusetts ban but said he didn't think current laws needed to change.

"I don't happen to believe that America needs new gun laws. A lot of what this ... young man did was clearly against the law. But the fact that it was against the law did not prevent it from happening," Romney said.

Authorities have said the suspected Colorado shooter, James Holmes, methodically stockpiled weapons and explosives at work and home in recent months. He bought thousands of rounds of ammunition and a shotgun, a semiautomatic rifle and two Glock pistols, authorities said.

Obama addressed the nationwide troubles in front of the Urban League in part because blacks, who make up the bulk of the organization's membership, have been disproportionately affected by gun violence. While mass shootings like the one in Colorado receive widespread attention, Obama said roughly the same number of young people are killed in the U.S. by guns every day and a half.

"For every Columbine or Virginia Tech, there are dozens gunned down on the streets of Chicago and Atlanta, and here in New Orleans," he said. "For every Tucson or Aurora, there is daily heartbreak over young Americans shot in Milwaukee or Cleveland."

Why Relationships Fail ?

Relationships fail for many reasons. You?ve seen it happen a thousand times and I?ve seen the same. And while each relationship is composed of different parts and therefore is its own unique snowflake, it doesn?t change the fact that a lot of relationships end for the same reasons. Taking the time to list all the reasons why relationships fail would take a very long time and since I know our attention spans are lucky to last even past this paragraph, how ?bout we just examine three of the major reasons and call it a day? Sound good? Good!

Behold, three popular reasons relationships go the way of the dodo bird:

The ?Me! Me! Me! Me! Me! Me! Me!? Reason
We humans are a selfish lot as a whole, so it?s only fitting that some of us set aside the wants and needs of our significant other and instead, try to make everything in our relationships about us. We want attention and affection without giving any in return. We decide things without considering our partners position on the situation. We pitch a fit (that may be a Southern saying??) when things don?t go exactly our way. All of these actions (and these are just a few samples of selfish behavior) weaken a relationship to the point of collapse if the behavior isn?t remedied.
If we care about our partner and want our relationship to progress and flourish, it?s important to make our union one of compromise and consideration. It takes communication and acknowledgement that we?re not the only ones affected by our actions or attitude. We have someone else who?s there to help us and for us to help in return. A relationship is about give and take; being selfish hampers that process to the point of relational death.

?What We Have here is a Failure to Communicate!?
As I?ve said a hundred or so times, communication is the key to any successful relationship (or so I?ve been told; I?ve never actually had a successful relationship so?). That means sharing the good AND the bad with your partner.
Feeling down for one reason or another? Instead of letting your stressful situation affect your relationship in a negative way, trust your partner by letting them into what?s bothering you. Not only will sharing your problems lighten your load, but a united front of you and your significant other together will make your issue easier to face.
It?s when we bury things deep down inside and refuse to confide in our partner that we begin to allow our relationship to be torn apart. And unless you?re actually wanting the relationship to end, that is not a good thing.
Share and share alike to give your relationship the chance to survive it deserves.

?When Three Become Twooooo? (Yes, I just paraphrased a Spice Girl song. Sue me)
The Spice Girls song referenced above actually says, ?When two become one?? but for the sake of this article, I had to switch it up a bit.
Some times in our relationships, we think that we are the only two people needed to make a relationship successful. And in that thought process, we are wrong because a relationship bent on being a success wisely includes God as well. ?It takes three to make a thing go right? if you will (that song reference may be too ancient for like 90% of my readers?).
If we build our relationship on the will of God, then we are more likely to have a better, more fulfilling relationship. Sure, there are relationships not built on the will of God that have been successful, but why not utilize the One who holds our lives in His hands in the first place? Exactly! We should!
Our God wants the best for us in every aspect of our lives, so if we allow Him to be an equal member of our romantic relationship (not in the creepy way. Jesus isn?t your boyfriend or your lover), then we?re crawling closer to being where He wants us to be in life.
Including God in our lives is never a bad thing. And to include him in our relationship only increases the chance that things will end in ?Happily Ever After? instead of ?I never want to see your stupid face again!?

Books of Adam: Iron Goddess of Mercy

The legend goes like this:

In southeast China there was a rundown temple which housed an iron statue of the Bodhisattva Guanyin, the Goddess of Mercy. A poor farmer passed the temple each morning on his way to the tea fields. He would look upon the temple with a heavy heart, noting its crumbling condition.
Because the farmer was poor, he had not the means to restore the temple?s glory. Still, he wanted to do something. He brought a broom from his home and swept the temple clean of debris, then lit some incense as an offering to Guanyin. He did this each day for many months. ?It?s the least I can do,? he said. One night, the Goddess appeared to him in a dream and told him of a hidden cave behind the temple where great treasure awaited.
She told him to claim the treasure as a reward for his hard work and share it with the others in his village. The next day, the farmer searched and found the cave the Goddess spoke of, but upon entering found no great treasure. Instead, he found only a tiny tea shoot poking up through the ground. He was disheartened.
The farmer took the tea shoot anyway and planted it on his farm. To his surprise, it grew into a hearty bush from which the finest tea was produced. He gave cuttings of it to his friends and family, and they began selling it. Before long the village prospered and grew famous for its delicious tea. As thanks to the Goddess, they named the tea after her: Tieguanyin. The Iron Goddess of Mercy.

I drink Tieguanyin most nights. Occasionally I?ll switch up the tea I drink, but Iron Goddess of Mercy is the one I continually return to. Making tea is a ritual I look forward to. My workload has a tendency to pile up and the ritual of brewing tea offers momentary respite, during which time I can clear my head and recalibrate. I focus on the steps: filling the tea bag, boiling water, steeping the tea, then waiting for it to cool so I can drink it. It?s a simple ceremony but a calming one, and the legend behind the tea?s origin serves as a hopeful reminder that everything I do will one day amount to something more. It offers solace from the stress of my life, however fleeting.

Another little ritual I have is laying on the floor in the dark, panicking over the notion that I?m wasting my formative years on misguided endeavors.
In these ephemeral moments of despair, tea is of little help. While I?m comforted by the fact that everyone my age deals with the same ambiguities and insecurities, it doesn?t negate the sobering fact that I periodically have, and will continue to have, these big moments of complete and all-consuming doubt that seem like they might cause my whole life to derail?but then watch a bunch of Roseanne episodes or go get some Thai food from the place down the street, and tell myself that everything is all right, and I make some lists in my head and set some goals and before long it?s tomorrow and I?m fine.
???????????
Everybody?s twenties are marred by uncertainty. This is fact. I?m 25, about to be 26, which means I?ve begun that slow crawl toward 30. It feels like a good place to pause and reflect on what I?ve learned so far.

1. I Can?t Keep Dating Douchenozzles, Hoping To Turn Them Into Good People

This has taken me ages to learn, and I?m still not sure it?s sunk in all the way. Barring one notable exception, I?ve dated pretty much exclusively garbage-people. For a while, it was fun to imagine that I could reform someone else, like a science project. A part of me still hopes I can find someone to mold into the perfect human specimen, as if I?m building a mate from carefully selected parts.

In reality, I have a hard enough time changing myself. There?s no way I could possibly change another person.

2. I Can?t Eat The Way I Used To

I will probably never be fat. Looking back at the men in my family, not a one of them was anything other than lean (and usually downright noodly), and for this I am thankful. Still, I?m discovering that I can?t continue to shovel food into my gullet and expect to maintain a figure like that of Christian Bale in The Machinist. Now when I eat loads of shitty food, I find myself feeling lazy and lethargic. I have to run longer on the treadmill to maintain my Voldemort-like physique. In a couple years I?ll most likely have to move up a belt size, from 28 to 29, which is too traumatic to dwell on. It would be so much easier if I could eat like I did when I was 16, but I fear that will lead to dark places.

3. I Can?t Drink Like I Used To

I?ve always been a pretty responsible drinker (ahem, sort of) but I just can?t keep up with my younger self any longer. A few months ago I went out for a friend?s birthday and consumed what seemed like a perfectly reasonable number of vodka tonics. I went to bed and woke up the next morning with a crippling hangover. I spent the entire morning on the floor of my living room, my head pounding like Denver the Last Dinosaur was about to hatch from my skull.

In college I could spend the night partying, get 3 hours of sleep, wake up feeling buoyant and refreshed, and go to my 8 AM class without a care in the world. Now if I have too much to drink, I have to personally call FEMA to deliver me a bag of Egg McMuffins.

4. Money Vanishes

I try to keep an eye on my bank account but it still feels like cash is being steadily funneled out of my possession and into a void. I feebly attempt to cling to my finances, yet frugality seems like a nonsense notion in my twenties.

It?s almost sneaky the way it happens. A couple visits to the Las Piedritas taco truck for $5 burritos, a night out at Wimpy?s for $2.50 well drinks, a too-good-to-pass up sale on Bonobos.com, then a couple auto-payments hit my account for bills and my gym membership, and suddenly I have $500 less in checking than I did the week before. It?s as if I?m tying hundred dollar bills to my cat and sending her off into the wilderness, never to be seen again.
Before I realize what?s happened, I?m destitute, with nothing to show for it except a burrito-induced tummy ache and orange chino shorts that don?t even fit because of all the burritos I?ve been eating.

5. I Am Jealous Of Everyone For Their Success, Be It Real Or Imagined

I?m at that age where many of my friends are getting married and having little goblin offspring of their own. Every week I open my mailbox to find save-the-dates and wedding announcements, oftentimes from people I hardly remember. The barrage of invites is endless.

I remember being eight and adamantly claiming I?d never get married (unless it was to Sailor Moon) and that I?d rather die than have children of my own. I?ve softened somewhat on the notion of children, though currently I can?t imagine my life with a son or daughter present. I can fathom no worse hell than having to pause my Skyrim game to change a diaper, and yet I somehow find myself jealous of all my friends who are getting married and becoming pregnant. It shouldn?t be a competition. I don?t even want to get married and I certainly don?t want kids right now, but I still stare at all the wedding announcements pinned to my fridge with a mixture of envy and loathing.
I try to remind myself that this is just a symptom of the Facebook age and that we all make unreasonable comparisons about ourselves and our peers. Then I brew a scalding hot cup of Tieguanyin and casually pour it out the window onto some unwitting passerby.

6. Despite The Pervasive Uncertainty Of Life, I Am Gaining Perspective

Though my days are often filled with a vague sense of dread and forboding, there are moments of profound insight, and I cling tightly to these, collecting them in my subconscious like precious jewels so that I may reference them later. These moments usually manifest in small and quiet ways?an electric, passionate discussion with a friend, or a walk through the city when the weather is perfect and the streets are buzzing with life. These moments are like little islands of positivity. Sometimes I get tired of swimming, but I trust there?s another little island on the horizon.

I like to think that when my twenties come to a close, I will be at peace with myself and at one with the universe, wise and tranquil like a spiritual Maharishi.
For now, I?ll draw and I?ll write, and I?ll try to learn new things, and I?ll attempt to take something positive away from every experience I have, no matter how small. I?ll try to keep my finances in check and be nice to my friends even when they?re being insufferable little shits, because I love them and I know they?re the same as me. And I?ll make Tieguanyin tea at night, and imagine the Iron Goddess watching over me, telling me that someday all my insecurities and second-guessing will melt away, and everything will be good, and I will stop worrying.
